Purchase Agreement

This Agreement is entered into between the Seller, Flatcat Exotics ("Breeder") and Buyer ("Buyer") for the purchase of a kitten/cat. By submitting this form and/or taking possession of the kitten/cat, you acknowledge and agree to all terms below.

1. Deposit Acknowledgment

I acknowledge that a $500 deposit per kitten/cat is non-refundable and serves as consideration to reserve a specific kitten/cat or future placement. I understand that the deposit is not contingent upon future health outcomes and will not be refunded for any reason.

2. Pet-Only & Care Agreement

I acknowledge and agree that this kitten/cat is sold as a "pet only" and agree to the following care requirements:

Care commitments

Spay or neuter the kitten/cat at the appropriate age (breeding is strictly prohibited unless otherwise agreed in writing)

Keep the kitten/cat indoors only

Not declaw the kitten/cat

Provide proper nutrition, routine veterinary care, and a safe home environment

Avoid exposure to unknown animals during the initial adjustment period

I understand that failure to comply with any care requirement voids this health guarantee

3. Breed Acknowledgment & Buyer Due Diligence

I acknowledge that I have researched the Exotic Shorthair breed and understand the unique characteristics, care requirements, and potential challenges associated with owning an Exotic Shorthair.

I understand Exotic Shorthairs are a brachycephalic (flat-faced) breed

I understand they may require routine eye and facial cleaning

I understand they may experience mild breathing noise, snoring, or tear staining

I understand they may require increased veterinary monitoring compared to some other breeds

I acknowledge that these breed-related traits are not defects, but normal characteristics of the breed, and agree that the Seller shall not be held responsible for conditions or challenges commonly associated with the Exotic Shorthair breed

4. Veterinary Examination Requirement

I agree to have the kitten/cat examined by a licensed veterinarian within seventy-two (72) hours of delivery (excluding weekends and holidays). I understand that failure to complete this examination within the required timeframe automatically voids this health guarantee

I understand that I assume full responsibility for all veterinary care and medical expenses after delivery, without exception

5. Health Guarantee

Seller guarantees that the kitten is in good health at the time of sale. Prior to delivery, each kitten will receive a wellness check by a licensed veterinarian and perform a Triple SNAP test (FELV/FIV/Heartworm).

If, within seventy-two (72) hours of delivery, a licensed veterinarian diagnoses a life-threatening congenital defect that existed at the time of sale, Buyer must notify Seller immediately and provide written veterinary documentation.

At Seller's sole discretion, Seller's obligation shall be limited to providing a replacement kitten of comparable value, when available.

Conditions:

The original kitten must be returned to Seller immediately
Written documentation from a licensed veterinarian is required
Seller reserves the right to request a second examination by a veterinarian chosen by Seller
Buyer is solely responsible for all transportation costs, including return of the original kitten and delivery or transport of any replacement kitten
No cash refunds will be issued for any reason

This remedy constitutes Buyer's exclusive remedy under this Agreement.

I understand the health guarantee terms: If within seventy-two (72) hours of delivery, a licensed veterinarian diagnoses a life-threatening congenital defect that existed at the time of sale, I must notify Seller immediately and provide written veterinary documentation

I understand that at Seller's sole discretion, the remedy is limited to providing a replacement kitten of comparable value when available, and that no cash refunds will be issued for any reason

I understand that I am solely responsible for all transportation costs, including return of the original kitten and delivery or transport of any replacement kitten

6. FIP (Feline Infectious Peritonitis) Disclosure & Exclusion

I acknowledge and agree that FIP is not covered under this health guarantee beyond the initial seventy-two (72) hour period

FIP understanding

I understand that FIP is believed to result from a mutation of feline coronavirus, which is common and often dormant

I understand that FIP cannot be reliably predicted, prevented, or genetically guaranteed

I understand that FIP may develop weeks, months, or years after the kitten leaves Seller's care

I understand that because FIP may be influenced by stress, immune response, and environmental factors outside Seller's control, Seller shall not be held responsible for any FIP diagnosis occurring after delivery

7. Health Guarantee Exclusions

I understand this health guarantee does not cover:

Exclusions acknowledgment

Viral or bacterial infections contracted after leaving Seller

Parasites or minor, treatable conditions

Upper respiratory infections

Stress-related illnesses

Injuries, accidents, neglect, or improper nutrition

FIP beyond the initial seventy-two (72) hour period

Conditions related to surgeries, including spay or neuter, or reactions to anesthesia

8. Veterinary Expenses

I acknowledge that Seller does not reimburse veterinary bills, medications, diagnostics, or emergency care under any circumstances

9. Limitation of Liability

I understand that to the fullest extent permitted under Texas law, Seller shall not be liable for emotional distress, incidental damages, consequential damages, or veterinary expenses. Seller's maximum liability, if any, shall not exceed the purchase price of the kitten

10. Governing Law & Venue

I understand this Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Venue for any dispute arising under this Agreement shall lie exclusively in the county in which the Seller resides

11. Severability

I understand that if any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect

Final Acknowledgment

I acknowledge that I have read, understood, and voluntarily agree to all terms of this Agreement and have had the opportunity to ask questions prior to purchase
